These Terms of Service ("Terms") govern your access to and use of the ServiceBooked website located at servicebooked.ca, and any related products or services provided by ServiceBooked("ServiceBooked", "we", "us", or "our").
By accessing or using the website or our services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use our Services. By using ServiceBooked, you represent and warrant that you meet these requirements.

ServiceBooked provides software and automation tools designed to help service-based businesses manage bookings, customer communications, payments, and related business operations. Our Services may include CRM functionality, scheduling, messaging, payment integrations, and analytics.
We may modify, suspend, or discontinue any part of the Services at any time without notice.
3. Account Registration
To access certain features, you may be required to create an account. You agree to:
Provide accurate and complete information
Maintain the security of your login credentials
Notify us immediately of any unauthorized use of your account
You are responsible for all activity that occurs under your account.
4. Fees and Payments
Certain Services may require payment of fees. By purchasing a paid plan, you agree to:
Pay all applicable fees as described at the time of purchase
Authorize us or our payment processor to charge your selected payment method
Provide current, complete, and accurate billing information
All fees are non-refundable unless otherwise stated in writing. We reserve the right to change pricing with reasonable notice.
5. Free Trials and Promotions
We may offer free trials or promotional pricing at our discretion. Unless canceled before the end of a free trial, your account may automatically convert to a paid subscription.
6. Acceptable Use
You agree not to use the Services to:
Violate any applicable laws or regulations
Send spam, unsolicited messages, or unlawful communications
Transmit malware, viruses, or malicious code
Infringe upon the rights of others
Abuse, interfere with, or disrupt the Services or systems
We reserve the right to suspend or terminate accounts that violate this section.
7. Communications and Messaging Compliance
If you use ServiceBooked to send SMS, email, or automated messages, you are solely responsible for:
Obtaining proper consent from your recipients
Complying with all applicable laws, including CASL, TCPA, and similar regulations
ServiceBooked is not responsible for your messaging content or compliance failures.
8. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. By using ServiceBooked, you consent to the collection and use of information as described in that policy.
You retain ownership of your data. You grant ServiceBooked a limited license to store, process, and transmit your data solely to provide the Services.
9. Intellectual Property
All content, software, trademarks, and materials provided by ServiceBooked are owned by or licensed to us and are protected by intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
10. Third-Party Services
The Services may integrate with third-party services such as payment processors or messaging providers. ServiceBooked is not responsible for third-party services, content, or failures.
Your use of third-party services is subject to their respective terms and policies.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or misuse the Services.
Upon termination, your right to use the Services will immediately cease. Outstanding fees remain payable.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Services, including fitness for a particular purpose or uninterrupted availability.
13. Limitation of Liability
To the maximum extent permitted by law, ServiceBooked shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or business opportunities.
Our total liability shall not exceed the amount paid by you to ServiceBooked in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless ServiceBooked from any claims, damages, losses, or expenses arising out of your use of the Services, your data, or your violation of these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.
16. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.
